The dispute between Softcare SN Company Limited and Dr. Moussa Diallo, inspector and head of mission at the Pharmaceutical Regulatory Agency (ARP), was heard on March 19, 2026, before the Dakar Criminal Court. However, the case was adjourned until June 4, 2026, pending payment of the deposit.

A quote was introduced from Me Sayba Danfakha, counsel for Softcare, who accuses the head of the ARP of remarks deemed "seriously defamatory" made in the columns of "L'Observateur" on December 22, 2025.

In this edition of the daily newspaper, Dr. Moussa Diallo, speaking as part of an inspection mission related to the quality of hygiene products, stated that "Chinese people came to his office four times, carrying suitcases full of money and gifts," adding that he was offered a discreet meeting in a restaurant.

Softcare, whose management is implicated in these statements, formally denies them. Through its lawyers, the company denounces the allegations as "completely unfounded" and damaging to its honor, reputation, and professional image, both nationally and internationally.

According to the plaintiff, the offending remarks were relayed not only by "L'Observateur", but also by other press outlets and online platforms, including "Le Quotidien", Dakaractu and Atlanticactu, thus reinforcing their impact on the public.

Softcare's advisors believe that these publications constitute public dissemination within the meaning of the Penal Code, citing the provisions of article 258.

For Softcare, Dr. Diallo's remarks, suggesting attempts at corruption, fully constitute the offense of defamation, or even complicity for the media outlets that relayed these statements.

Softcare believes that these accusations have contributed to discrediting its activities, particularly in a sensitive sector related to public health.

For his part, Dr. Moussa Diallo, who has not yet been heard on the merits, will have to explain himself at the hearing on June 4, 2026.
