Chambre criminelle de Dakar : Ndella Madior Diouf obtient la liberté provisoire
Despite the prosecutor's opposition, Ndella Madior Diouf was granted provisional release by the Dakar criminal court. She was tried this morning along with her assistant, Cheikh Tidiane Ndiaye, and the radio host El Hadj Sène.
While the prosecution has requested five years of imprisonment for her and three months for the other defendants, her lawyers, Maitres Ousseynou Gaye, Youssoufa Camara Abdoul Daff, Aboubacry Barro and Co., have pleaded for acquittal.
According to Ms. Gaye, Ndella Madior Diouf has a deep-rooted sense of humanity, which is why she created SOS Santé to help women who are victims of unwanted pregnancies and paternity denial. Her personal experience served as her roadmap.
That is how, when a young girl grabbed it to tell it that she was going to commit suicide, Keur Yeurmandé was born and welcomed about sixty babies.
According to the defense, she was arrested for offenses "that don't hold water." For Ms. Gaye, the offense of illegally practicing medicine is not established, due to a lack of repeated acts that could prove her guilt. A single death certificate is insufficient to establish the offense.
Regarding the charge of endangering the lives of others, the lawyer argues that it only applies when someone's life is actually exposed to danger. He contends that this has not been demonstrated by sound reasoning. Finally, concerning involuntary manslaughter, he asserts that no negligence has been proven.
At the conclusion of the arguments, a request for provisional release was made in court. The judge sought the prosecutor's opinion, who opposed it in the case of Ndella Madior Diouf, while giving a favorable opinion for Cheikh Tidiane Ndiaye and El Hadj Sène.
Finally, the chamber granted provisional release to all the accused before adjourning the case for deliberation until May 26, 2026.
Upon hearing the decision, Ndella Madior Diouf burst into tears.
