Mise en danger de la vie d’autrui : ce que risque Softcare
Interviewed by L'Observateur, Professor Iba Barry Camara, a criminal lawyer, stressed the seriousness of the acts attributed to the company Softcare, recalling that placing expired products on the market constitutes an offense severely punished by law.
He explains that the marketing of such products, particularly when they are intended for vulnerable people such as babies or women, constitutes a serious crime of endangering the lives of others.
According to him, the hygiene code is explicit: simply possessing expired products intended for sale is enough to incur criminal liability. The penalties range from two to three years imprisonment, along with fines and the immediate seizure of the offending goods.
The offence is constituted as soon as the intention to put these products into circulation is established, even before their actual sale.
The expert also points out that hygiene officers have extensive powers, allowing them to apprehend offenders and bring them before the prosecutor.
Finally, the interlocutor of the Future Media Group calls on women's and parents' rights associations to fully assume their role of citizen oversight, by strengthening control and vigilance around products placed on the market, in order to guarantee better consumer protection.
A true public health scandal. As a reminder, the Senegalese Pharmaceutical Regulatory Agency (ARP) announced the immediate suspension of sales of Softcare diapers and sanitary napkins for public health reasons. According to the inspection services, the team sent to the site discovered that expired raw materials were being used in the manufacture of products intended for babies, children, and women. The regulatory body warns that the suspension will remain in effect until the factory is fully compliant and the new raw materials are approved.
