Actes contre nature : Pourquoi Aly Ngouille Ndiaye valide l'option du gouvernement contre la criminalisation
The Senegalese government recently adopted a bill aimed at strengthening legislation on so-called unnatural acts and the glorification of homosexuality, while also introducing penalties for slanderous accusations. According to the Senegalese Radio and Television Broadcasting Corporation (RTS), this initiative is generating widespread public debate.
When questioned about the relevance of this approach, former minister Aly Ngouille Ndiaye welcomed the government's choice to strengthen sanctions without resorting to criminalization. "Personally, I was not in favor of criminalization, because it is not clear that it will solve the problem," he stated.
The former presidential candidate points out that experience shows that criminalizing other offenses, such as rape, cattle rustling, or drug trafficking, does not always guarantee swift and effective sentencing. The problem lies in the limited number of judges in the country: “We are 18 million Senegalese for approximately 500 judges. Criminalizing these acts means sending people to prison, but how many will stay there long?”
For Aly Ngouille Ndiaye, the government's decision is "a good step" because it allows for the protection of public opinion and the punishment of apology, while taking into account judicial constraints and Senegal's international commitments.
He also stressed the importance of respecting local sensitivities: "More than 99% of us are believers. Our culture doesn't accept that. We can't legislate based on other cultures."
However, he acknowledges that the debate on criminalization remains open and reflects the diversity of opinions within society. "It's normal that some continue to insist on criminalization. But I consider what the government has done to be commendable and adapted to the realities of Senegal," he concludes.
