Affaire Bineta mécanicienne et Cie : de lourdes peines de prison requises par le procureur

The Pikine-Guédiawaye court of summary jurisdiction heard the so-called "Bineta mechanic" case on Wednesday, involving fourteen defendants, including students. They are being prosecuted for charges including criminal conspiracy, endangering the lives of others, fraud, illegal possession of a bladed weapon, corruption of minors, and the illegal operation of a tourist accommodation establishment.

At the heart of the case: a furnished apartment in Keur Massar, rented for two days at a price of 70,000 FCFA, where the events allegedly took place.

Amadou Woury Diallo, a pharmacist by training, presented as the manager of the furnished apartment, denied the charges. He did, however, admit to having rented the family apartment for the first time, claiming he trusted his nephew, Oumar Diallo, who had introduced him to a tenant who had provided identification. The prosecution, however, pointed out that the rent had been paid for via Wave transfer, casting doubt on the theory of a simple family arrangement.

Oumar Diallo, a student born in 2004, denied any involvement, claiming he only handed over the keys to Madjiguène Ndiaye, one of the defendants.

Young people were invited for a "reunion..."

Several defendants, including Diminga Basse, Aïssatou Ndiaye Diop, Souleymane Sonko, Fallou Mbow, and Amara Mboup, stated that they had been invited for a simple get-together during the holiday season, denying any knowledge of illegal activities. Some admitted to contributing towards the cost of food and drinks.

Madjiguène Ndiaye, who has a prior conviction, presented herself as the organizer of a New Year's Eve party among friends, denying any corruption of youth and claiming to be unaware of the existence of videos or drugs.

The defendant, Olivier Bampoky, a student, admitted to possessing a bladed weapon without authorization, while denying that he had injured anyone. He admitted to handing over bicarbonate of soda instead of the drug known as "Nb," which he claimed had been ordered by Aïda Souaré, an act the judge characterized as fraud. An altercation broke out after the transaction was canceled.

Aïda Souaré admitted to noting that the substance handed over was not a drug, while denying any association with criminals.

The case of Bineta the mechanic

Binta Sarr, born in 2003 in Diourbel, a mechanic, is being prosecuted for conspiracy, endangering the lives of others, and corrupting minors. She denied the charges against her. She stated that she was with Abdou, a friend who rides motorcycles, until 6:00 PM in Castors. He allegedly told her he needed an apartment, and she drove him to Keur Massar, to the apartment of Amadou Woury Diallo, where three other people were already present. She added that she took the opportunity to broadcast the encounter live on social media. Binta Sarr maintained that she only knew Madjiguène Ndiaye and that she had spoken with the landlord about renting the apartment.

In his closing arguments, the public prosecutor deemed the facts particularly serious, citing concerted action, the involvement of minors, and the operation of an apartment without administrative authorization. He requested a guilty verdict for all the defendants, seeking: two years' imprisonment for Amadou Woury Diallo, Oumar Diallo, Aïda Souaré, Fallou Diop, and Binta Sarr; and two years, with six months to be served, and a fine of 200,000 FCFA for the other defendants. The prosecution also requested the closure of the apartment in question.

The defense lawyers contested the charge of conspiracy, arguing that no prior criminal agreement had been established. They denounced a "moral trial," maintaining that the group had simply gathered as young people to celebrate the New Year, without any shared criminal intent.

Regarding Amadou Woury Diallo, the defense argued the absence of a causal link between the rental of the apartment and the alleged acts, requesting his acquittal for endangering the lives of others.

The court rejected the applications for provisional release, citing a persistent threat to public order and the lack of guarantees of appearance. The case was adjourned for deliberation until January 19, 2026.
