Affaire des 21 milliards F CFA : l’épouse de Madiambal Diagne remporte une victoire
The president of the panel of investigating judges of the Financial Judicial Pool (PJF) has ordered a further medical examination for Mabintou Diaby, the wife of journalist Madiambal Diagne. She has been in pretrial detention since the end of September as part of an investigation into suspicious transactions, documented in a CENTIF report concerning the execution of a public contract worth 21 billion CFA francs.
The Observer, which provides the information, suggests that through this decision, taken on December 15, the judge is seeking to form an opinion before deciding whether the state of health of the accused is compatible or not with detention in a prison environment.
Even though her client is not yet out of the woods, this is a victory for the defense. On October 21st, she had filed a request with the investigating judge for a medical examination of Ms. Diagne. But the request went unanswered.
"Her medical file is insufficient. We want her to be consulted by specialists in her disease and that is why we have requested a much more thorough expertise," said one of the lawyers for the accused, who spoke to L'Observateur after being notified of the news.
The order from the president of the panel of investigating judges of the Federal Judicial Police (PJF) has been sent to the defense and the State Judicial Agent (AJE), according to Le Quotidien. Each side has three days to submit its observations.
Mabintou Diagne is being prosecuted for conspiracy, fraud involving public funds, and money laundering committed by an organized criminal group. She was arrested almost simultaneously with two of Madiambal Diagne's children (one of whom was granted provisional release) and a friend of his. This occurred shortly after her husband, who claims he never received a travel ban, flew to France. The journalist is the subject of an arrest warrant and an extradition request.
Less than a month after being returned to prison, Ms. Diagne was transferred to the Main Hospital before being admitted to the Special Ward. Her lawyers and human rights advocates want her released, citing her worrying state of health.

Quand c'est dakar qui doit être impacté, une circulaire en bonne et due forme est publiée pour avertir les populations. Quant à nous rien du tout... trop c'est trop depuis des années personne n'est capable de regler ce problème mais là c'est abusé

L’Observateur, qui donne l’information, suggère qu’à travers cette décision, prise le 15 décembre, le juge cherche à se faire une religion avant de décider que l’état de santé de la mise en cause est compatible ou pas avec la détention en milieu carcéral.
Même si sa cliente n’est pas encore sortie d’affaire, il s’agit d’une victoire pour la défense. Le 21 octobre dernier, elle avait saisi le juge d’instruction d’une requête aux fins d’expertise médicale pour madame Diagne. Mais la demande est restée sans suite.
