Affaire West Africa Energy : La Chambre d’accusation annule l’ordonnance de renvoi contre Samuel Amète Sarr
The Indictment Chamber of the Dakar Court of Appeal, meeting on January 27, 2026, overturned the committal order for Samuel Amète Sarr to stand trial before the criminal court, according to one of his lawyers, Baboucar Cissé. This decision also terminates the warrant for his release issued in the West Africa Energy case, in which the former Minister of Energy, Samuel Sarr, was remanded in custody.
The overturned order had been issued by Makha Barry, investigating judge of the 2nd chamber of the Dakar High Court, at the conclusion of the investigation opened against Samuel Amète Sarr. Following an appeal by the defense, the Indictment Chamber ruled that the legal conditions for referral were not met, thus invalidating all the contested actions.
This court decision is hailed as a major victory by Samuel Amète Sarr, who has consistently contested the charges against him and proclaimed his innocence since the start of the proceedings. It strengthens the defense's position, which had denounced irregularities in the conduct of the investigation.
However, this setback is a blow to the civil parties, Moustapha Ndiaye and others, as well as to the investigation conducted by the judge assigned to the case. Samuel Amète Sarr's defense had notably alleged an investigation marked by relentless pursuit and a lack of impartiality.
