Chambre criminelle de Thiès : le parquet demande l'acquittement pour B. Fall, accusé de viol sur sa cousine
The criminal chamber of the Thiès High Court examined, on Monday, February 23, a case involving B. Fall, a young man prosecuted for rape, pedophilia, and abduction of a minor against his 13-year-old cousin, Ndèye Mour. The alleged events took place in April 2023 in the Fahu neighborhood of Thiès. According to the girl's accusations, the defendant raped her twice in their grandmother's room.
In court, the accused categorically denied the charges against him. He maintained that he had never had sexual relations with the young girl, believing that these accusations stemmed from a dispute between his family and that of the victim.
For her part, the minor, Ndèye Mour, maintained her accusations before the court. She claims she was assaulted twice in her grandmother's room, taking advantage of her mother's absence. According to her testimony, the accused threatened her to prevent her from revealing the events, which would explain her initial silence.
The teenager's mother stated that she had noticed unusual changes in her daughter's behavior before taking her to the hospital. A gynecological examination revealed an old rupture of the hymen. However, the mother emphasized that her daughter had initially named someone else as the alleged perpetrator before mentioning B. Fall's name. In court, she admitted that she could not definitively confirm the perpetrator's identity, citing her daughter's allegations as contradicted by the defendant's denials.
The public prosecutor stated that the only established fact in this case was the girl's loss of her hymen, which was confirmed by a gynecologist. He found no evidence to suggest that the accused was responsible. The prosecution noted that even the victim's mother could not corroborate this. Therefore, they requested an acquittal based on reasonable doubt.
At the close of the hearing, the defense, represented by Mr. Mbodj and Mr. Sène, requested provisional release. This request was rejected by the court, which then set the date for the verdict for March 23, 2026.
