Cour suprême : L'arrêté de nomination d’Aloïse Moise Baba Diouf annulé
On May 8, 2025, the Supreme Court annulled the August 1, 2024, order of the Minister of Health and Social Action appointing Aloïse Moise Baba Diouf as director of the Talibou Dabo Center, replacing Lansana Sidibé. The latter had been appointed by presidential decree on June 13, 2019, under the presidency of Macky Sall.
Referred to by Mr. Sidibé, the high court ruled that the minister was incompetent to take such an action, a prerogative reserved exclusively to the President of the Republic, in accordance with Articles 42, 43, 44 and 59 of the Constitution.
The Court noted that only a decision of the same hierarchical level, namely a presidential decree, could terminate Mr. Sidibé's functions, in accordance with the principle of parallelism of forms. However, no decree has repealed the 2019 decree. Furthermore, a procedural defect was noted, as the ministerial decree did not mention any deliberations of the Council of Ministers, a mandatory procedural requirement.
By combining these two grounds (incompetence and procedural defect), the First Administrative Chamber of the Supreme Court annulled Order No. 017689/MAS/DAJ of August 1, 2024.
