Cour suprême : Pourquoi le recours de Ousmane Sonko a été rejeté
On July 1, the Supreme Court, sitting in Joint Chambers, rejected the appeal for a ruling filed by lawyers for Ousmane Sonko, then an opponent, in the case against former minister Mame Mbaye Niang. This decision sparked anger and incomprehension within the camp of the leader of Pastef, now in power.
Sonko's lawyers had invoked a "procedural error" to challenge the court's previous decision, Les Échos recalled in its Tuesday edition. According to the high court, this argument was actually aimed at challenging the court's reasoning and obtaining a new judgment on the merits of the case.
Four main grievances had been raised: the dismissal, out of time, of an exception of unconstitutionality of article 260 of the Criminal Code; the absence of mandatory referral to another jurisdiction after cassation; an alleged distortion of the act of summons to the accused; and the addition of a mention on the execution of the judgment not provided for by law.
After reviewing the case, the Court found that these arguments did not constitute a genuine procedural error and that they were merely intended to challenge its own logic. The current Prime Minister's request was therefore rejected, concludes Les Échos.

Ce genre de magistrats sont a l'affût pour terrasser le régime cas ayant reçu et certainement continuer de recevoir des opposant voleurs milliardaires des fonds pour ce funeste projet de perpetuation du système.
Le rabat d'arrêt est un recours technique et difficile et si l'on s'amusait à faire des statistiques on verrait que les chances de succès d'une requête en rabat d'arrêt sont infimes; peut-être de l'ordre de 7 %
