Décision de la Cour d'appel de Versailles : La lecture du colonel Sankoung Faty
A dispassionate and objective reading is necessary of the Versailles Court of Appeal's decision in the case between the State of Senegal and Madiambal Diagne. It is indeed the State of Senegal from which the French judges in Versailles requested additional evidence to support their extradition request. In other words, the judges found that the content of the file submitted by the Senegalese justice system was insufficiently argued in terms of legal grounds, given Madiambal's responses, to justify his extradition.
Hence the latter's triumphant cry: "A fine lesson in justice in Senegal." This Senegal of great magistrates like Kéba Mbaye, Isaac Forster, and Ousmane Goundiam, who demonstrated to the world the quality of our magistrates and our justice system, even at the dawn of our independence. This quality was maintained until its consecration by the international community's choice of Senegal to host the first hearings of the Extraordinary African Chambers in Dakar.
Today, we are tempted to question the quality of the legacy passed down by these illustrious predecessors, particularly since the Karim Wade affair, before the United Nations Human Rights Committee. The Committee's strong recommendations in this case led us, in an article published by the newspaper "Le Quotidien" on November 4, 2018 (https://lequotidien.sn/ce-quil-faut-savoir-du-comite-des-droits-de-lhomme/), to make proposals for the reform of the CREI (Special Court for the Repression of Economic Offenses), ultimately resulting in the establishment of the Financial Judicial Pool.
It is therefore with full legitimacy and with the same commitment to citizen contribution to strengthening the rule of law, that we are sounding the alarm so that our justice does not pale in comparison to the international community and donors in particular.
This decision by the Versailles Court of Appeal should be seen as (to use a football analogy) a yellow card following the verbal warning of the lifting of the judicial supervision order on Madiambal Diagne. The image of Senegal and the prestige of its justice system are worth more than any trial, especially when the prosecution process takes on such a controversial character.
Those held in pretrial detention must therefore be tried as quickly as possible, in strict compliance with the time limits prescribed by the Code of Criminal Procedure, thereby demonstrating the fairness and equity of our justice system, as demanded by the judges of Versailles and by Senegalese civil society. The judicial reforms that civil society has supported, particularly the establishment of the judge of liberties, must be implemented without delay.

Le pourvoi de l’ancien président contre sa condamnation dans l’affaire Bygmalion était examiné ce mercredi 8 octobre................L’ancien chef de l’État (2007-2012) est revenu au premier plan de l’actualité il y a deux semaines avec sa condamnation en première instance à Paris dans le procès libyen à cinq ans d’emprisonnement ferme, assorti d’un mandat de dépôt avec exécution provisoire, c’est-à-dire immédiate.
Bien qu’ayant fait appel, il sera donc prochainement incarcéré, une première dans l’histoire de la République.

Quand à la justice française, ma question est de savoir si elle doit apprécier les faits reprochés ou juste apprécier si Madiambal aura droit à un procès respectueux de ses droits et des standards.
L’acte de fuite de Madiambal laissant femme, enfants et biens témoigne de sa culpabilité !!!
Qui va laisser des immeubles, comptes bancaires et œuvrer pour ne pas revenir sauf si ses biens sont illicites ?
Sa famille lui appartient; du moins je présume
