Transfer to a suitable hospital or release from detention? The Criminal Chamber of the Supreme Court will rule on the fate of Farba Ngom on January 12. The member of parliament and mayor of Agnam, and leader of the APR party, is seeking to have his continued detention overturned, citing a worrying state of health.
In this case, Les Échos recalls, four specialists – including a cardiologist and a urologist – concluded that the politician's health is incompatible with the prison environment, due to a lack of suitable technical facilities.
Based on these expert opinions, the defense invokes Article 140 of the Code of Criminal Procedure, which requires the judge to order the release of the detention order when the health of the accused is in danger.
Until now, the investigating magistrate had only sent him to the special ward, and the Indictment Chamber ordered his transfer to a suitable facility, without lifting the detention order. Dissatisfied, the defense appealed to the Supreme Court.
As reported by the newspaper, Farba Ngom's lawyers believe that their client, having already been heard on the substance of the case, should now be able to receive appropriate care in complete freedom.
