Fraude systémique à l'état civil : Justice sans frontière interpelle la ministre de la Justice, Yassine Fall
The organization Justice Without Borders (JSF) has sent an alert to the Minister of Justice and Keeper of the Seals, Yassine Fall, denouncing what it describes as an organized fraud affecting the foundations of the national legal order.
In this official letter, JSF raises the alarm about practices it describes as systemic within certain civil registry centers.
"Consistent reports indicate fraudulent practices within certain civil registry centers, involving public officials who, in exchange for undue advantages, illegally assign Senegalese identities to third parties, including foreigners," declare El Amath Thiam and Co.
They stress that these events go beyond isolated cases and, according to them, characterize a structural degradation of the civil status, a pillar of the legal identity of persons, administrative security and national sovereignty.
"This phenomenon is no longer a matter of isolated cases. It reflects a systemic dynamic of degradation of the civil status, which constitutes the basis of the legal identity of persons, of administrative security and of the sovereignty of the State," they say.
On the criminal side, JSF lists the charges that could be brought against the alleged perpetrators. They state: "These acts are likely to be classified as criminal offenses including forgery and use of forged public documents, corruption, identity theft, and criminal conspiracy."
The victims of this alleged fraud are primarily Senegalese citizens living abroad. JSF describes the extent of the harm suffered as follows: “Many Senegalese citizens, particularly those living abroad, are discovering that their civil status data (birth certificates, identification numbers, parentage information) has been improperly used by third parties. This results in significant harm: inability to obtain official documents, administrative obstacles, challenges to their identity, legal uncertainty, and exposure to unjustified legal disputes.”
The organization also denounces an additional obstacle which, according to them, worsens the situation for victims and fosters impunity for alleged perpetrators. "Some victims encounter administrative refusals or inaction in obtaining the certificates necessary to regularize their situation, which contributes to prolonging their suffering and maintaining impunity," JSF stated.
