« Il n'a pas... » : un juriste prend le contre-pied d'Ousmane Sonko
In an interview with L'Observateur, Dr. Mor Fall, a lecturer at the Faculty of Legal and Political Sciences (FSJP) of Cheikh Anta Diop University (UCAD), contradicts Ousmane Sonko. The constitutional expert believes that, despite the National Assembly's adoption of the proposed constitutional amendment, the process is not yet complete. According to him, Article 103 of the Constitution grants the President of the Republic the final say: he can either submit the text to a referendum or choose to have it approved by Parliament with a three-fifths majority.
Recalling that "Article 103 presents no ambiguity in its wording," he firmly contests the assertion that the Head of State is obligated to promulgate the text after its adoption by the National Assembly. According to the legal expert, this argument, put forward by the Speaker of the National Assembly, "is not based on sound legal principles," believing that the Speaker "has not understood the procedural steps that must be followed."
The source interviewed by the Groupe Futurs Médias newspaper also emphasized that President Bassirou Diomaye Faye is not subject to any deadline for convening the electorate for a referendum, as this prerogative falls under his "discretionary power." Since the head of state has the exclusive authority to convene the electorate, the academic believes he can, if he so chooses, "neutralize the completion of the revision process."
