La Lonase déboutée : la saisie de plus de 421 millions F CFA confirmée
The Senegalese National Lottery (Lonase) has just suffered another setback in its legal battle with KO Company SUARL. The court rejected its requests to overturn the seizure, thus confirming the validity of the debt recovery proceedings initiated against it.
Seized with a challenge to the seizure of movable property, the competent court dismissed the objection of nullity raised by Lonase and declared KO Company's action admissible. It upheld the attachment of receivables carried out in November 2025, while limiting the amount to 421,394,780 CFA francs.
This decision is in line with the evolving case law on this matter. In January 2024, the Common Court of Justice and Arbitration (CCJA) of OHADA had already overturned a ruling by the Dakar Court of Appeal that had granted Lonase immunity from execution. The highest court reiterated that, "although owned by the State," Lonase remains a private legal entity and "therefore cannot benefit from such immunity," reports Les Échos.
The daily newspaper notes that this dispute stems from an initial ruling against Lonase ordering it to pay over 900 million CFA francs to KO Company. Despite a memorandum of understanding signed in 2016, the commitments were not met, and the dispute continued in court.
After several years of proceedings and successive appeals, this new decision confirms the rights of KO Company and strengthens the financial pressure on Lonase, whose assets remain exposed to the forced recovery procedure.
