"La profession de magistrat est incompatible avec le populisme" : Ousmane Chimère Diouf égratigne les députés
At the General Assembly of the Union of Magistrates of Senegal (UMS), President Ousmane Chimère Diouf reacted strongly to the provision in the National Assembly's internal regulations providing for the possibility of summoning magistrates. He reaffirmed the independence of the judiciary and recalled the constitutional limits of Parliament.
"The principles that govern our profession are incompatible with populism," Diouf said. He explained that the UMS had chosen to remain silent until the Constitutional Council's decision. "Decision No. 2C-2025 of July 24, 2025, ruled that certain paragraphs of Article 56 of the National Assembly's Rules of Procedure are contrary to the Constitution," he said.
Ousmane Chimère Diouf stressed that "Parliament can monitor government action and hear members of the executive or heads of public institutions, but no constitutional provision allows it to hear magistrates in the exercise of their functions." He added that internal regulations, even in the form of an organic law, cannot modify or contradict the Constitution.
The UMS president recalled that the justice system has its own control mechanisms: "Organic Law No. 2017-10 provides for the prosecution of a magistrate before the disciplinary council or criminal prosecution in the event of an offense." He refuted the idea of total impunity for magistrates, which is often wrongly conveyed.
Mr. Diouf clarified that any hearing of a magistrate by the Assembly should be authorized by the Minister of Justice, and not imposed by a direct summons. He also rejected the idea of the army intervening to execute warrants, recalling that this is the responsibility of judicial police officers.
The UMS president opposed the integration of non-magistrates into the High Council of the Judiciary, believing that no solid argument justifies such a reform.
Ousmane Chimère Diouf called for respectful dialogue between institutions, in the exclusive interest of the people. "The judge must remain subject to the authority of the law, calm, lucid, and independent, regardless of pressure," he concluded.

Le magistrat est payé par le peuple pour rendre la justice au nom du peuple représenté par les elus du peuple (les députés) qui proposent et votent les lois.
