Mbour : 20 ans de réclusion requis contre un sexagénaire pour viol sur une fillette de 12 ans
In her pleated red dress and a black scarf tied around her head, K. Faye's still-youthful face eloquently testified to her young age. In the courtroom of the High Court, in the criminal chamber, the awkwardness was palpable, particularly due to the age of the two protagonists.
Alongside the young K. Faye, the sexagenarian Alassane Omar Sow was answering for the crimes of rape of a minor under 13 years of age, abduction and pedophilia.
The events date back to 2021, in the Médine neighborhood. Old man Sow was a regular at the restaurant owned by Ndella Diouf, the victim's mother. When she brought him her meal, the old man took advantage of the situation to have sexual relations with her on two occasions.
K. Faye, 12 years old, recounts that "Pa Sow" had abused her twice. After each encounter, her abuser offered her the sum of 500 francs.
When questioned about his heinous act, the sexagenarian mumbled: "Dama dioum" (I made a mistake).
Clearly irritated by "Pa Sow's" actions, the judge retorted: "She could be your granddaughter!"
“You say you did not abuse her, but you should not have sexual relations with a child. If she were an adult, the fight would have been fair. But she was only 12 years old. If it were done to your child, you would not like it. So what you do not want done to your child, do not do to another person’s child,” the judge admonished.
The accused retorted, "She consented." A response that infuriated the judge and the prosecutor.
To the mother and the audience, the judge said: "Stop sending your children to run errands for people older than themselves. The damage has already been done in this case. But I urge all parents to stop sending their children to elderly people. A person can appear responsible and upright, but be vile in their actions."
The girl's mother explains that she was informed of her daughter's pregnancy seven months into her pregnancy.
“I saw her sleeping every time, but I never thought she was pregnant. I thought she had worms that I was treating. Until the day I took her to the hospital and they told me she was pregnant,” explains Ndella Diouf.
During the interrogation, the prosecutor first sought to establish the defendant's family background. The defendant indicated that his eldest daughter, born in 2005, was married. The prosecutor then questioned the defendant about certain intimate gestures, including physical contact such as kissing or caressing; the defendant denied these allegations. However, when questioned about sexual intercourse, he admitted to having had intimate relations with the young woman.
During the court proceedings, it emerged that the child born of this reprehensible act is now four years old and had, in fact, left for Koranic school that day. The girl's mother is seeking 2 million CFA francs in damages.
The prosecutor requested a 20-year prison sentence.
Mouhamed Fadel Fall, the lawyer for the elderly Sow, tried his best to defend his client. He emphasized the child born of this act who, tomorrow, will ask his family who his real father is.
Alassane Omar Sow will learn his fate on March 20th.
