Offense au chef de l’État : Azoura Fall condamné malgré ses excuses
Assane Guèye, a Pastef party activist and farmer and vehicle seller residing in Patte d'Oie, was tried this Tuesday before the Dakar court of flagrant offenses for insulting the head of state, after the objections of nullity raised by the defense were rejected.
Azoura Fall had made remarks deemed disrespectful towards Bassirou Diomaye Faye, during the installation of the new president of the National Assembly, Ousmane Sonko.
In court, Azoura Fall admitted to the facts: "It was me who made those remarks. I was angry. It was the journalists who had interviewed me at the Assembly. I spoke in the heat of the moment. After making those remarks, I regretted them once I got home."
“Diomaye is like a father to me. I cannot imagine him separating from his friend Ousmane Sonko,” added Azoura Fall, who regretted the events and promised not to make such remarks again.
However, he denounced the conditions of his arrest. “My mother’s boubou for Tabaski is still in the car. I was supposed to spend the holiday with my family. Besides, even during Korité, the prosecutor had arrested me. Afterwards, he had me committed to the Thiaroye psychiatric hospital. He said I was crazy. What hurts me the most is that my mother knows about it,” Azoura stated.
The public prosecutor reminded him that it was his lawyers who had produced his medical file. In his observations, the prosecutor stated that the facts against the defendant were consistent and requested a sentence of two years' imprisonment, with six months to be served.
The defense, led by lawyer Ciré Clédor Ly, argued for freedom of expression. "A head of state who doesn't accept criticism isn't a head of state. I know Diomaye; he wouldn't file a complaint against Azoura," the lawyer maintained, before asking the court to acquit his client.
In delivering its verdict, the court declared the defendant guilty of the acts and sentenced him to 6 months imprisonment, including one month of mandatory imprisonment, and a fine of 100,000 CFA francs.
