Pr Iba Barry Kamara : « Aminata Touré ne peut pas être poursuivie sans enquête approfondie »
Pastef is putting pressure on President Bassirou Diomaye Faye to have the report from the State Inspectorate General (IGE) implicating Aminata Touré in her management of the Economic, Social and Environmental Council (CESE) (2019-2020) sent to the courts. For several days, numerous party officials, including Fadilou Keita, have been repeatedly calling for legal action, citing financial irregularities estimated at nearly 2 billion CFA francs. These actions are part of the momentum initiated by Ousmane Sonko during his "tera meeting" on November 8th.
When questioned by L'Observateur, specialists in public law and administration reiterated that Aminata Touré's legal fate rests solely with the President of the Republic. Iba Barry Kamara, Professor of Public Law, and Abdou Fouta Diakhoumpa, a specialist in public administration and instructor at the National School of Administration (ENA), emphasized that the IGE reports are strictly intended for the Head of State, who alone holds the "sovereign authority" to decide on the appropriate course of action.
No obligation to transmit
Diakhoumpa insists: "The President has no obligation to transmit the reports. The IGE reports are intended exclusively for him. He is not even obligated to transmit them to the Prime Minister. The head of the IGE is the President of the Republic, not the Prime Minister."
Conditions of prosecution
For legal proceedings to begin, two conditions are necessary: the declassification of the report and the President's assessment of whether the facts are sufficiently serious to warrant referral to the prosecutor. Professor Kamara points out that "being singled out does not mean being guilty" and that "without a thorough investigation, Mimi Touré cannot be prosecuted."
Pressure deemed illegitimate
The constitutional expert warns against political pressure. "Wanting to pressure Bassirou Diomaye Faye into doing something he doesn't want to do raises questions. Can pressure be exerted on the President?"
For the interviewee of the Groupe Futurs Médias newspaper, the answer is no.
