Procès contre la SGBS : Moustapha Tall débouté
The verdict has been reached in the long-running legal battle between businessman Moustapha Tall and Société Générale Sénégal (formerly SGBS). The bank, along with its executives prosecuted for "fraud in court proceedings," have been "simply acquitted," reports Les Échos.
The same source adds that the court also rejected the compensation claims made by both parties. Moustapha Tall, who was claiming 10 billion CFA francs in compensation for his damages, was unsuccessful, as was the bank, which had filed a counterclaim for 20 billion.
The dispute concerned the seizure and subsequent "enforcement of the mortgage guarantee through forced expropriation" of a building belonging to Moustapha Tall in June 2015, for 400 million, the newspaper recounts. The businessman contested the legality of this transaction, asserting that "no liquid and due debt was established" at the time of the sale, and accused the bank of having used "fraudulent maneuvers" to secure the auction.
To support his claims, he cited the 2021 annulment (confirmed in 2022) of an initial payment order for over 973 million. Despite this annulment, SGBS initiated new proceedings to claim 574 million, presented as the "remaining balance of the debt after deduction of the auction price." This latter proceeding is, moreover, the subject of an appeal that is still "pending before the Dakar Court of Appeal," the daily newspaper added.
