Chambre criminelle de Dakar : Serigne Assane Mbacké et ses coaccusés risquent 10 ans de prison
A bizarre case involving a famous marabout preacher was heard this Tuesday in the Dakar Criminal Court. The accused is Assane Mbacké, also known as "Serigne Assane Mbacké," 41, a marabout residing in Ndiarème Limamoulaye, single and childless. In court, the religious leader was accompanied by his friends: Khadim Samb, also known as "Djimbory," 41, a religious singer residing in Ndiarème Limamoulaye; Abdourahmane Lo, 43, a receptionist at the Hotel Nina, residing in Yoff Apecsy 1, married with one child; Ibrahima Badiane, also known as "Maitre l'Ouest" or "IB," 38, a perfume vendor residing in Yoff Apecsy, divorced with one child; and Baidy Hamady Sow, 34, a carpenter residing in Guédiawaye, single and childless. They were charged and remanded in custody on July 5, 2022, for rape, corruption of minors, human trafficking for sexual purposes, abduction of minors, and acts against nature against Ousmane Diouf and Mamadou Sow. The public prosecutor requested 10-year prison sentences for all of them.
A look back at the accusation
According to the partial dismissal of charges and referral to the criminal court issued by the investigating judge of the 3rd chamber of the Dakar High Court on August 10, 2021, Abdoulaye Siga Diouf had filed a complaint with the Special Cybercrime Division against persons unknown for acts of sexual abuse and exploitation committed against his 16-year-old son, Ousmane Diouf, by a homosexual network. During the investigation, he explained that for some time, his son, Ousmane Diouf, a student in his second year of high school at Taiba ICS, had been led astray by individuals engaging in homosexual acts. He stated that he had been informed of this situation by the school principal, who had made the discovery after confiscating his son's cell phone.
Heard in the presence of his father, the victim confirmed the headmaster's statements. He specified that he had been engaging in unnatural acts since the 2021 school holidays. He claimed to have been initiated by a certain Serigne Assane Mbacké, a neighbor of the family in Guédiawaye. He also explained that during those holidays, he had been sent to the marabout's home to bring him food. The marabout first complimented him before introducing him to a friend named Baidy, who declared his love for him. To further ensnare him, Serigne Assane offered him small sums of money and a Samsung J7 phone, which his mother eventually confiscated.
Continuing his revelations, he stated that a few days later, Serigne Assane Mbacké invited him to his room where he and Baidy threatened him, forcing him to undress before Baidy, aided by his friend, raped him. The victim added that Baidy had used a white liquid called "Cyteal" as a lubricant, stating that he had bled and experienced stomach pains. To prevent him from reporting this, Serigne Assane threatened him with death, mystical attacks, and threatening to denounce him as homosexual.
Following this incident, O. Diouf claims that the marabout put him in contact with several of his acquaintances, either directly or via Facebook, in particular with the users of the profiles "El rey lo" and "Maître de l'ouest" named respectively Abdourahmane Lo and Ibrahima Badiane.
He reveals that he thus went to the Nina hotel where Abdourahmane Lo works and to Ibrahima's home in Yoff, where he had unprotected sexual relations with them, the day after and the day after Korité 2022. After these sexual relations, he had received 20,000 each time from Lo and 5,000 F from Badiane which he gave each time to Assane Mbacké at his request.
The minor also revealed that in addition to having had sexual relations with a man named Djimbory, on two occasions, and with Mr. Sow, aged 17, at the request of Assane Mbacké who organised these meetings in his room, he was raped by Djimbory in the presence of Serigne Khadim Mbacké who had overpowered him.
When questioned, Yaye Fatou Diop, O. Diouf's mother, maintained that she had never suspected the marabout Assane Mbacké of pedophilic acts on her son, especially since she had grown up with him in Guédiawaye and considered him a religious figure with disciples within the Mouride brotherhood.
This reveals the exploitation of phones
Technical investigations carried out on the mobile phone and the Facebook profile "yeung foreshi Diouf" belonging to O. Diouf revealed multiple exchanges with phone numbers registered in the name of "Maitre Louest L'ouest" and "El rey" and Facebook profiles opened in the same names, belonging respectively to Ibrahima Badiane and Abdourahmane Lo.
In addition, the medical examination carried out on O. Diouf, following a request addressed to the director of the Principal Hospital of Dakar, revealed "lesions, fissures at the level of the anal margin".
Mr. Sow, whose real name is T. Khamary, aged 17, stated that he too had been sexually abused by Serigne Assane Mbacké during the COVID-19 pandemic. Mbacké, after raping him and threatening to have him assaulted if he reported him, arranged for him to have sex with the young O. Diouf in his room and forced him to sodomize him in front of him.
T. Khamary also revealed that Serigne Assane put him in contact with Djimbory, who also raped him under the promise of giving him a new pair of shoes.
Following these revelations, investigators arrested Ibrahima Badiane alias "Maitre L'Ouest L'ouest" alias "IB", Abdourahmane Lo alias "el rey" and Khadim Samb alias Djimbory.
When questioned, Ibrahima Badiane and Abdourahmane Lo confirmed that they had met O. Diouf on Facebook. Ibrahima admitted in detail to sodomizing O. Diouf in his room in Yoff. Abdourahmane Lo, for his part, maintained that he had only flirted with the young man and inserted his finger into his anus during their meeting at the Nina Hotel. They later admitted to giving the victim gifts and money at his request.
However, the accused denied knowing Assane Mbacké, let alone having been put in contact with Diouf by him. Baidy Hamady Sow denied engaging in unnatural acts with O. Diouf. But confronted with images found on his cell phone showing a young boy engaging in indecent exposure, he eventually confessed to having put two young men known as "Baby Joe" and "Lamzo" in contact with a prostitute named "Davala" based in Ngor. When questioned about a photo in his phone's trash showing the buttocks of a naked boy, he claimed it was a picture of his own buttocks that he had taken to ask a pharmacist for advice on treating pimples.
When questioned, Khadim Samb, also known as "Djimbory," confessed to receiving oral sex from the young O. Diouf and to having sexual intercourse with him. He stated that their meeting was facilitated by Assane Mbacké, who had arranged it in his room and in his presence. He added that he had given O. Diouf 6,000 CFA francs.
He also revealed that Mbacké had told him that the young T. Khamary was homosexual. He took advantage of this to lure him to Pikine to have sexual relations with him.
Khadim Samb specified that he had been sentenced to five years in prison for unnatural acts and then to one month imprisonment for attempted pedophilia.
Sexual urges towards young boys
When questioned, Assane Mbacké initially tried to deny the allegations. However, confronted with the incriminating evidence, he confessed to abusing the young men O. Diouf and T. Khamary in his room. He explained that he had met Diouf through Baidy Hamady Sow. Regarding T. Khamary, he emphasized that they lived in the same neighborhood and that he had known him since childhood. He sometimes asked him to run errands for him.
Continuing, he confessed to being plagued by sexual urges towards young boys that he was unable to control. While admitting to having sodomized the aforementioned individuals, he confirmed having arranged sexual relations in his room and in his presence between Khadim Samb, alias Djimbory, and T. Khamary, alias M. Sow.
When questioned about the money paid by Khadim Samb and the oral sex performed on him by O. Diouf, he stated that he did not remember such acts. However, he denied any involvement on his part in the sexual acts that occurred between Baidy and O. Diouf in his room or in his presence.
And in an attempt to exonerate himself, he suggested that young O. Diouf was not a novice with men. The young man had confided in him that he had been abused since childhood by Clément Massamba and Jean, both residents of Mboro, as well as by his tutor.
An examination of Assane Mbacké's mobile phone revealed a compulsive consumption of homosexual videos. When questioned, he claimed he watched them for his own pleasure.
Furthermore, to justify their homosexual tendencies, Assane Mbaké and Khadim Samb claimed to have suffered sexual abuse during their childhood, while attending the daaras of Khelcom
The victim changes their story
When questioned again, O. Diouf partially recanted his initial statements, notably maintaining that he knew Ibrahima Badiane and Abdourahmane Lo without Assane Mbacké's involvement. He also claimed to have harbored homosexual desires for a long time, but that he was persuaded to act on them by Assane Mbacké, who even went so far as to ask him to court some of his acquaintances, including Yahya and Fofana.
He added that he had told Abdourahmane Lo that he had been raped by his cousin in order to convince him to have sex with him.
Finally, O. Diouf confirmed having had sexual relations with Baidy Hamady Sow and Assane Mbacké, specifying that he had refrained in his initial statements from denouncing the sexual relations he had with the latter for fear of reprisals.
Charged with rape, corruption of minors, trafficking in persons for sexual purposes, abduction of minors and unnatural acts, Assane Mbacké, Khadim Samb, Abdourahmane Lo, Ibrahima Badiane and Baidy Hamady Sow contested the charges.
When questioned by the investigating magistrate, the victim, O. Diouf, and his father, Abdoulaye Siga Diouf, essentially reiterated their statements made to investigators. The minor insisted that Assane Mbacké exerted such psychological pressure on him that he carried out all his instructions. Mbacké sometimes forced him to leave Mboro to meet him in Guédiawaye. He also reported violence inflicted upon him by Mbacké, who would rough him up to force him into sexual acts when he resisted.
Father Diouf and his son also pointed out that Assane Mbacké was a friend of Ousmane Diop, O. Diouf's uncle, with whom he lived.
During their substantive hearings, the defendants recanted their confessions made during the investigation, maintaining that they had never sexually abused the victims. Abdourahmane Lo and Ibrahima Badiane stated that they met O. Diouf on Facebook. Lo asserted that he never sought an intimate relationship with him. On the contrary, he claimed that O. Diouf had made advances towards him, which he had not responded to.
Ibrahima Badiane also confirmed that O. Diouf had visited him at his home in Yoff to see the items he was selling online. However, he stated that nothing had happened between them. He added that Diouf often called him to ask for financial assistance, but to no avail. He thus refuted the accusations, specifying that they were made as a result of pressure exerted by investigators.
Baidy Hamady Sow, while confirming the presence of Serigne Assane Mbacké and Djibory, denies having been introduced to the former and O. Diouf. He stated that he leaves his home at 6:00 AM and does not return until around 10:00 or 11:00 PM. Consequently, he could never have met O. Diouf around 5:00 PM at Mbacké's residence, whom he has not seen for four months.
Khadim Samb also categorically denied O. Diouf's accusations, maintaining that he had only seen the latter once, in front of Serigne Assane Mbacké's home.
Serigne Assane Mbacké also adopted the same stance. He claimed he did not know Abdourahmane Lo and Ibrahima Badiane. Furthermore, he admitted to not being familiar with Facebook. Finally, he emphasized his status as a religious leader and his public profile, stating that this position prevented him from committing the acts attributed to him.
The victim is claiming 50 million CFA francs in damages and interest.
In court, Serigne Assane Mbacké and his associates contested the charges against them. The victim, O. Diouf, claimed 50 million CFA francs in damages. T. Khamary, however, made no claim for civil damages. The defense lawyers argued for acquittal based on reasonable doubt.
The case is adjourned for deliberation until December 2, 2025.

A bon entendeur
