Thiès : Un professeur d’EPS jugé en appel pour actes contre nature sur un élève de 6e

The Thiès Court of Appeal re-examined on Tuesday, February 24, a case of pedophilia and unnatural acts involving physical education teacher Pape Ciré Sall and his former student, A. Kane. The events date back to 2020 in Mbour, where the teacher, now 43 years old, is accused of repeatedly abusing the middle school student, then 13 years old. The case was initially tried in 2024 by the Criminal Chamber of the Mbour High Court.

Charged with rape, pedophilia, and acts against nature, Pape Ciré Sall was acquitted of rape but found guilty of pedophilia and acts against nature. He was sentenced to 10 years' imprisonment and ordered to pay five million CFA francs in damages. The defense appealed.

In court on Tuesday, A. Kane, now a high school senior, maintained his accusations. He recounted that his teacher had asked for his phone number. Not having a personal phone at the time, he had given him his parents' numbers.

According to her testimony, the teacher then invited her to his home, under the pretext of organizing a party for his students. "When I arrived, he received me in his friend Talla Fall's room. I asked him where my classmates were, and he replied that they were on their way. He started caressing me, then propositioned me for sex. I tried to refuse, but he threw me onto the bed and undressed me. He then took off his pants to penetrate me. He satisfied his libido before letting me leave," the victim recounted.

A. Kane added that after this act, his stomach hurt. He also explained that once he returned home, the professor called him back and asked him never to reveal what had happened between them.

"He kept calling me and messaging me on WhatsApp, and kept inviting me to his house for sex. He committed unnatural acts with me on four occasions. Then he threatened to lower my grades if I told my parents," the victim said.

His mother emphasized that the affair came to light when the boy's sister discovered the love messages Pape Ciré Sall was sending on WhatsApp. "We found love messages and obscene messages on my phone that were being sent to him. He had saved the number in question under the name 'My Dad.' We also noticed that this same number often called his father's phone. When pressed with questions, he finally revealed that the number belonged to his teacher, Pape Ciré Sall," said A. Kane's mother.

Pape Ciré Sall again denied the accusations in court. He stated that the victim had never entered his room and that he had never sent her messages or called her on the phone.

However, according to the case file, A. Kane was not the accused's first victim. He had also been accused of unnatural acts by a 16-year-old tailor named Dominique. That case was hushed up.

During the preliminary investigation, the accused had nevertheless told the police that he had been advised by a marabout to have a sexual relationship with a man to cure his infertility.

Furthermore, the analysis of his mobile phone had allowed investigators to discover eight videos showing sexual relations between men.

His lawyers argue that Pape Ciré Sall was wrongly convicted in the first instance, maintaining that no material evidence supports the accusations. According to them, the case rests solely on the victim's statements, which are contradicted by their client's consistent denials. They have therefore requested that the first instance judgment be overturned.

Conversely, the lawyers for the civil party consider that the court proceedings clearly established the guilt of the accused and asked the court to confirm the sentence announced by the criminal chamber.

As for the public prosecutor, he is convinced that the accused committed unnatural acts against his student, A. Kane, over whom, he says, he held authority. The prosecution believes there is sufficient evidence to incriminate the defendant and has requested that the first-instance judgment be upheld.

The verdict is scheduled for March 24, 2026.
