Tivaouane : S. M. Ndiaye acquitté de viol, mais condamné à 2 ans de prison pour attentat à la pudeur
The Criminal Chamber of the High Court of Thiès has delivered its verdict concerning the young SM Ndiaye prosecuted for rape and pedophilia.
The judge acquitted him of the pedophilia charges and reclassified the rape charge as indecent assault. He ultimately found SM Ndiaye guilty of this charge and sentenced him to two years in prison. His trial took place on January 13, 2026.
The defendant was accused of sexually assaulting N. Ndiaye, who was 12 years old at the time of the events which took place in 2022 in Tivaouane.
In court, SM Ndiaye denied the accusations. He stated that on the night in question, he was at the victim's home to talk to her and that he never raped the girl.
A. Fall, the victim's mother, had given an accusatory testimony, claiming to have caught the accused in an uncomfortable position with her daughter in the bedroom.
The public prosecutor had determined that the defendant was guilty of the charges and had requested a 10-year prison sentence.
