Transmission du VIH et code pénal : le rappel de la loi après le démantèlement du réseau de Keur Massar
The recent arrest of twelve people by the Keur Massar gendarmerie, reported exclusively by Seneweb, has brought renewed attention to the strict legal framework governing the intentional transmission of the human immunodeficiency virus (HIV) in Senegal. This offense is severely punished under current legislation.
Among the charges against the accused are alleged acts of intentional HIV/AIDS transmission. This offense concerns individuals who, knowing their positive serological status, deliberately expose others to the virus, particularly through unprotected sexual intercourse, without prior information or informed consent from their partner.
The legal framework: Law No. 2010-03
Article 36 of Law No. 2010-03 of April 9, 2010 relating to HIV/AIDS provides for a prison sentence of five to ten years and a fine of between two and five million CFA francs against any person who, knowing their positive serological status and the modes of transmission of the virus, voluntarily engages in unprotected sexual relations with the intention of transmitting HIV to another person.
These provisions are supplemented by the Senegalese Penal Code, particularly in its section relating to offenses against physical integrity. Article 307 thus punishes harm caused to others through clumsiness, recklessness, negligence, or failure to comply with regulations.
The investigation is continuing under the direction of the competent judicial authorities. As Seneweb previously reported, all suspects were brought before the prosecutor's office at the Pikine-Guédiawaye High Court on Monday morning.
