The first court decision since the promulgation of the law toughening the repression of acts against nature: the Pikine-Guédiawaye High Court sentenced Mbaye Diouf this Friday morning to six years in prison and a fine of two million CFA francs, according to Seneweb sources. He was taken into custody by Prosecutor Saliou Dicko.
The arrest: caught red-handed near the national arena
It all began on April 2, 2026, in the late afternoon. A. Sagna, a heavy equipment operator residing in Pikine, went, as usual, to a garden located in the Technopole reserve, opposite the National Wrestling Arena, to visit a friend. Around 6:00 p.m., two men entered the garden and disappeared into the grass. Their suspicious behavior aroused the witness's suspicions, and he decided to approach discreetly.
Upon reaching their level, A.Sagna surprised Mbaye Diouf, trousers down to his knees, having sexual relations with another individual lying on the grass.
Seeing the witness approach, the partner immediately fled. Mbaye Diouf, hampered by his lowered trousers, was unable to escape. To prevent any dispute, Sagna filmed the scene before taking the accused directly to the Guédiawaye Central Police Station.
Custody: full confession during the first interrogation
Mbaye Diouf, 24 years old, a factory worker, was taken into custody for an act against nature. He was informed of his rights, including the right to legal counsel, which he stated he intended to use "when the time came."
When questioned, Mbaye Diouf immediately admitted to all the facts: "I am aware of the reason for my arrest. I immediately acknowledge the facts and remain available to answer all your questions."
He then recounted the events of the evening. That day, he had gone to the national arena to attend a wrestling match. At the entrance, he ran into his neighbor from Yeumbeul, Assane Diop, a mechanic, who didn't have enough money to pay for his ticket. According to Seneweb sources, Diop offered him sex for 2,000 FCFA.
Mbaye Diouf agrees. The two men then withdraw to the garden adjoining the arena to carry out the act, where the witness surprises them.
When questioned about his partner, Mbaye Diouf identified Assane Diop, a resident of the Afia 3 neighborhood in Yeumbeul, and stated he was ready to lead investigators to his home. He clarified that the agreed-upon sum had not yet been paid at the time of the arrest.
When questioned about his knowledge of the law, he stated: "I didn't know it was against the law." Before concluding: "I acknowledge the facts that led to my arrest. I regret what happened and ask for leniency from the justice system."
After 48 hours in police custody without incident, Mbaye Diouf was brought before the Pikine-Guédiawaye prosecutor's office on April 7. The search for Assane Diop, his partner who is on the run, proved fruitless.
Placed in pretrial detention by prosecutor Saliou Dicko for acts against nature and indecent exposure, the defendant was tried this Friday morning. The court delivered its verdict: six years in prison and a fine of two million CFA francs. Mbaye Diouf thus becomes the first person convicted under the new legislation toughening the penalties for acts against nature in Senegal. His alleged accomplice, Assane Diop, remains actively sought.
