Affaire Farba Ngom : "La procédure n'a pas été respectée" (Me Doudou Ndoye)
Following a second rejection of Mouhamadou Ngom's request for provisional release, known as "Farba," his lawyers returned to the proceedings in this case at a press conference this Sunday. Prosecuted for criminal conspiracy, fraud with public funds, and money laundering, Farba Ngom was remanded in custody on February 27, 2025, it should be noted.
After months of incarceration, his lawyers filed a request for provisional release, arguing that their client's health was not suitable for incarceration. The judge then issued his order refusing provisional release and requested his transfer to the special wing of Aristide Le Dantec Hospital.
The lawyers of the mayor of Agnams then appealed to the Financial Indictment Chamber of the Dakar Court of Appeal, which upheld the decision of the first instance on October 8, 2025.
Speaking to the press, one of Farba Ngom's lawyers, Doudou Ndoye, stated that the public prosecutor had not followed due process in this case. "Farba's file contains no intelligence whatsoever. He spent nine months in prison without the prosecutor being able to hear him. He was sent to prison only to then seek evidence. The worst thing is that Farba was not given a chance to defend himself. The prosecutor did not follow due process," he said indignantly.
The lawyer said that Centif is an administrative body under the authority of the Ministry of Finance and that it can receive information from anyone before submitting its report to the public prosecutor.
He also noted that the latter can place the accused person in custody without hearing them in the investigation, which Mr. Ndoye finds unfair.
He believes that when the prosecutor receives a report from the CENTIF, he must open an investigation into the charges against the accused before proceeding with his arrest. Mr. Ndoye reminds us that criminal procedure is the mother of power and that it is through it that we can defend individual freedoms.
"When we don't respect the procedure, we violate human rights," he insists, before announcing the publication of a book on financial crimes in Senegal on January 3, 2026.

Mais la situation économique du Sénégal ne laisse entrevoir aucune perspective heureuse : les notations négatives des agences internationales ont sapé la crédibilité du pays, jusqu’à transformer le forum des investissements en une simple vitrine de mensonges, de promesses creuses et de démagogie orchestrée par Sonko.
En tant qu element du système, avocat f.... m..... notoire de faire votre rédemption.
Nous ne sommes pas surpris de vous voir défendre des voleurs a grande échelle car c est le système. Des gens qui ont poignardé les Sénégalais dans le dos. Des gens qui méritent la peine capitale avec exécution sur la place publique.
