Supreme Court ruling flouted: Thiès's disaffected residents send out an SOS to Sonko

Arrêt Cour Suprême bafoué : les désaffectés de Thiès lancent un SOS à Sonko

"For four years, we have been victims of a serious injustice related to land, in the face of which we have remained powerless. Indeed, in 2020, our legally acquired residential plots located in the city of Thiès were illegally decommissioned under the pretext of non-development, outside of any cause of public utility. However, no regular decommissioning of land can be carried out without prior formal notice, which has never been done," declared the members of the Collective of the Disaffected of Thiès, deprived, according to them, of "land legally acquired by the town hall of Thiès and the Land Registry." During a press briefing held this Sunday, September 21, 2025 in Thiès, these "oppressed people," regretting that "all our appeals to the municipal and administrative authorities have remained unanswered," reiterated their desire to recover their plots.

They recall having been "unjustly dispossessed" of their land and hope for the intervention of the Head of State and his Prime Minister to "put an end to the illegality, the injustice and restore our rights." Especially since a ruling by the Supreme Court, handed down during its hearing on March 14, 2024, overturned the decision of "illegal decommissioning, carried out by the Thiès town hall and the Land Registry." Baba Sène, spokesperson for the collective, specifies: "In 2019, our residential plots, legally acquired, were decommissioned, without prior notice and outside of any cause of public utility"; "in full view of everyone, these plots were reassigned, for the most part, to non-needy individuals." "Several individual and collective approaches were taken by us, the victims, over several months with the State Property Department, mayors, the prefect, the public prosecutor at the time, among others, without success."

He continues: "In the midst of the Covid-19 pandemic, we created our collective, and for four years, we took all possible steps with the competent authorities of the time (local administration, communities involved and opinion leaders), without success"; "in May 2021, the Collective appointed the law firm (Études de Maîtres Amadou Sonko and Ibrahima Baïdy Niane) to bring the case to court"; "on May 3, 2024, the Collective sent a first letter to the President of the Republic to request his intervention"; "the Administrative Chamber of the Supreme Court, by its decision of March 14, 2024, annulled the decision to decommission our land." "In November 2024, notification of the Supreme Court's judgment was made by bailiff to all the structures involved and/or competent (administration, community) of the commune of Thiès," recall Baba Sène and his comrades. They note: "On November 29, 2024, a letter of complaint was sent to the head of the Thiès Estates Office to have our rights restored, without success"; "on January 5, 2025, the Collective sent a second letter to His Excellency the President of the Republic, informing him of the non-implementation of the Supreme Court's ruling, without response"; "on March 18, 2025, a request for an audience was sent to Mr. Ousmane Sonko, Prime Minister of Senegal, which remained unanswered." "To this day, we are still encountering difficulties in the execution of the Supreme Court's ruling, a final judicial decision, despite its receipt by all the competent services," complain the members of the Thiès Disaffected Collective.

They affirm that, despite "the injustice suffered," they have always wanted to be model citizens by respecting all the administrative and judicial procedures offered by the law of their country. They recall that "among us are widows and orphans, to whom their ancestors left, as inheritance, only these plots of land." They thus request the assistance of the President of the Republic, the Prime Minister and the country's senior authorities for "a diligent and effective implementation of the Supreme Court's ruling."

    C’est du grand banditisme, ils se sont partagés des terrains de pauvres citoyens, dont des défunts, des malades, incapables de se défendre. Même si les actes d’attribution fixent un délai de mise en valeur, c’est le partage qui est insidieux, scandaleux. En un temps record on a vu des immeubles construits sur ces terrains expropriés. Une véritable bombe qui peut révéler des pratiques très graves pouvant éclabousser à des niveaux insoupçonnés. C’est pourquoi je ne suis pas surpris que le traitement cette affaire puisse traîner. Je conseille aux victimes de porter plainte contre le Maire concerné et X.

    Des pères et mères de famille qui n’ont que leurs terrains comme biens un malhonnête maire les exproprie. Que Dieu vous assiste et répare cette injustice.

    Il faut mettre en valeur son terrain c est plus sûr
    Souvent on voit des terrains attribués depuis plus de 10 ans sans être mise en valeur même pas un brique ni une plante
