The Dakar Magistrates' Court tried Demba Diouf and Djiby Diouf, drivers residing in the Parcelles-Assainies neighborhood, on March 4, 2026. The two friends were accused of disseminating images contrary to public morals, illegally collecting personal data, violence, and assault. They possessed compromising images of the young woman, M. Sidibé, allegedly used to coerce her into sexual relations.
According to the investigation, Djiby Diouf captured an intimate moment, photographing Ms. M. Sidibé in an uncomfortable position. He then sent the photos to his friend Demba.
The plaintiff testified that it was Demba who sent her the nude photo. "I asked him where he got the picture. He didn't explain anything clearly. He told me that someone had given him their phone, that he had seen the photo and sent it to me," she stated. She specified that the photo had been taken in Djiby's room.
According to the public prosecutor, Djiby Diouf intended to use the compromising image as a means of pressure to force the young woman to have sexual relations, even though she no longer wished to associate with him.
For his part, Demba tried to downplay his role. "It was Djiby who sent me the photo without explanation. I called the woman to tell her that this image could destroy her life. I advised her to stop this kind of behavior," he maintained.
During the hearing, Djiby Diouf denied any romantic relationship with the complainant. "We weren't a couple. She asked me for money every time she came to my place for sex. She wasn't my girlfriend; it was paid sex," he stated, while admitting to taking the photo: "I apologize. I took the photos by mistake."
The plaintiff claimed 200,000 CFA francs in damages. The public prosecutor requested the application of criminal law.
The two defendants, who appeared without legal representation, pleaded for leniency from the court. In his ruling, the judge acquitted Demba Diouf of the charge of disseminating images contrary to public decency. The initial charges of violence were reduced to assault. He was sentenced to one month of imprisonment.
As for Djiby Diouf, he was found guilty on all counts, including taking images without the victim's knowledge and using them for the purpose of coercion. He was sentenced to one year of imprisonment.
The court awarded Mr. Sidibé the sum of 200,000 CFA francs in compensation for the damage suffered.
