MFB, 36, is a Senegalese man who has lived in France since May 2022. He had applied for asylum, claiming he would be at great risk because of his homosexuality. His application was rejected and he was forced to leave France.
According to Les Échos, which recounts this story in its Monday edition, MFB's request was initially rejected by the French Office for the Protection of Refugees and Stateless Persons in May 2023. This decision will be confirmed "a few months later," according to the newspaper, by the National Court of Asylum. "In December 2023," continues the same source, "the prefect of Hérault notified him of an Obligation to Leave French Territory (OQTF) within thirty days, accompanied by a one-year ban on returning."
The Senegalese national contested the measure. The Montpellier court ruled in his favor, but only partially: while the re-entry ban was overturned, the OQTF (Order of Foreigners' Order) was upheld. MFB didn't budge: he appealed, insisting that he would face serious risks if he returned to his country. "At the hearing," reports Les Échos, "his lawyer insisted that his client had already suffered domestic violence and that he was accompanied to France by LGBT rights organizations, such as Fierté Montpellier Pride."
To reinforce its line, the black dress emphasizes that its client is in a relationship with a Frenchman and that he has taken multiple initiatives to achieve his social integration, notably by doing volunteer work and having managed to obtain a promise of employment.
The court did not consider these arguments sufficient to annul the Senegalese national's expulsion order.
