Tried before the Fatick court for flagrant offenses, the head nurse (ICP) G. Mbodj and the nursing assistant A. Diouf of the Ndiaye Ndiaye Wolof health post in the Djossong commune were acquitted after their appearance. G. Mbodj and A. Diouf were being prosecuted, respectively, for violating laws and regulations concerning burials and failing to assist a person in danger, following the death of young Seynabou, who was struck by a cart.

Admitted to the village health post after the accident, the victim was examined by the nurse, who administered paracetamol. The nurse indicated that she had not observed any apparent injuries or bleeding.

“I informed the parents that if they noticed any complications, they should bring the child back,” she testified, specifying that the head nurse was absent and that he had authorized her to provide care in his absence. These statements were confirmed by the ICP.

According to him, upon returning to the health post, the parents brought the child back a second time. Unfortunately, it was already too late; the victim had died.

Following the child's death, a controversy arose regarding the preservation of the body. Due to its relationship with Mr. Touré, the victim's grandfather, the ICP (Institut Catholique de Paris) agreed to keep the body in its office, as the morgue lacked adequate security. The next day, Mr. Touré came to collect the body, but was not issued a death certificate.

At the end of the debates, the public prosecutor requested a two-month suspended prison sentence and a fine of 200,000 CFA francs against the ICP and a three-month suspended sentence with a fine of 100,000 CFA francs against the nursing assistant.

The defense argued for the acquittal of the defendants, believing that the caregiver had indeed provided assistance to the child by consulting her and that the ICP could not be prosecuted for violating burial laws, as the burial had not yet taken place at the time of his arrest.

At the end of the proceedings, the court acquitted G. Mbodj and A. Diouf due to reasonable doubt.
