Guédiawaye : compte bancaire vidé, loyers dilapidés, enfant caché…, la famille de l’émigré décédé se déchire autour de son immeuble
A. Samaké was found guilty of breach of trust by the Pikine/Guédiawaye court of flagrant offenses, which sentenced her to three months in prison with a suspended sentence and ordered her to pay four million CFA francs in damages to the civil party.
The culprit is the niece of Mr. Dramé, an emigrant living in Germany who died in May 2024. According to the account in L'Observateur, which covered his trial, Mr. Dramé had absolute trust in A. Samaké. She oversaw the construction of his two-story building in the Golf district. She was also responsible for collecting the monthly rent, totaling 520,000 CFA francs, which she deposited into her uncle's bank account.
After Mr. Dramé's death, his niece continued to receive the money for twenty months, but no longer deposited it into the bank. The emigrant's brother and sister denounced this situation by filing a complaint against her.
In court, A. Samaké proclaimed her good faith. She maintained that she had allocated the funds to the operation and maintenance of the building: paying water and electricity bills, emptying septic tanks, taxes, and various other expenses. "The mandate ends with the death of the principal," the judge reminded the court, emphasizing that "no power of attorney authorized her to continue this management after the death of her uncle," according to the report in L'Observateur.
The defendant agreed, but claimed ignorance of the law. While pleading her client's good faith, the defense contested the plaintiff's status as an heir, asserting that the deceased had a child unknown to his family.
This revelation is disputed by one of the plaintiffs, H. Dramé, sister of the deceased emigrant.
During the hearing, according to the newspaper of the Future Media Group, it was revealed that two of Mr. Dramé's sisters had been the subject of a complaint for emptying their brother's bank account after his death. The matter was settled through criminal mediation, according to the same source.
A. Samaké was sentenced to three months suspended and ordered to pay four million CFA francs in damages to the plaintiffs.
