"He strangled me in the dark": She refuses the co-wife, her husband beats her and ends up in front of the judge!

The Pikine-Guédiawaye Magistrates' Court heard a domestic violence case on Monday involving AS Sow, an accountant residing in Keur Massar. He was charged with assault and battery resulting in a six-day work incapacity and making death threats against his wife, N. Cissé. In court, the defendant denied the charges against him. His wife firmly maintained her accusations.

In court, N. Cissé recounted that her husband had returned from a trip on the day of the incident. After opening the door for him, she went to bed only to find that the electricity had been turned off in her bedroom. "I went to ask him why he had turned off the circuit breaker. He strangled me and hit me in the face," she stated. The medical certificate submitted to the court documents swelling on the left side of her face and an injury to her shoulder.

He mentions tensions related to his second wife

AS Sow maintained that his statements recorded in the police report had been made under duress. Recounting his marital situation, he explained that the marital disputes began after he told his wife of his intention to take a second wife. According to him, this revelation severely damaged their marriage. He claimed that his wife had made his life miserable ever since and had even tried to jump out of the car he was driving.

The defendant admitted to an altercation on the day of the incident. However, he denied strangling his wife. "She had changed the locks and refused to open the door. The power was off. She kept turning the air conditioner back on to annoy me. We argued, and I pushed her away," he explained, while downplaying the strangulation allegations.

The judge, however, reminded him that during the preliminary inquiry, he had admitted to lightly strangling his wife.

N. Cissé confirmed that she was strangled by her husband after being punched in the jaw. She also mentioned a previous incident of violence that occurred ten days before the latest incident.

According to her lawyers, this was not an isolated incident but yet another blow suffered within the bonds of marriage. One of the civil party's lawyers indicated that a medical certificate issued in April already documented the violence. "Her maternal love and her desire to protect her children have kept her in the marriage until now," the lawyer argued, maintaining that the provisions of Article 294, paragraph 2 of the Penal Code should be applied to the husband. Attorney Malick Mbengue, who described the defendant as a violent husband, requested 500,000 FCFA in damages.

The public prosecutor has requested the application of criminal law.

The defense pleads jealousy.

The defendant's lawyers argued that he was not a violent man. Attorney Souleymane Soumaré questioned the purpose of the trial, suggesting that the case resembled a jealous rage more than a criminal matter. "Mr. Sow is a decent man and never intended to harm his wife," the defense pleaded, requesting an extremely lenient application of the penal code.

Me El Hadji Diène also mentioned a climate of jealousy linked to the defendant's second marriage. "From the beginning, we understood that the woman couldn't accept her husband taking a second wife," he stated, adding that the complainant had initially considered withdrawing her complaint before changing her mind.

In its ruling, the court acquitted AS Sow of the charge of making death threats. However, the judge reclassified the charges from assault and battery to simple assault and battery before finding him guilty. The defendant was sentenced to three months' imprisonment, suspended. He will also have to pay 300,000 FCFA in damages to his wife.

    @Dagga  Tu es tres courageux. Sais-tu au moins, qui dit la verite? Les querelles liees a l'AMOUR sont complexes. Il faut aussi comprendre ce qu'une femme peut ressentir lorsque son HOMME decide de lui coller une co-epouse. C'est tres douloureux.

    Le problème est qu’au Senegal le mariage est considéré par les femmes comme un ascenseur social.Si vous vous mariez a une femme khessalisé qui a beaucoup investi sur son corps et n’a qu’un trou à vous offrir tôt ou tard vous vous en aurait assez de la routine quotidienne,elle ne parle que de sexe du matin au soir et attendre tout de vous.D’abord.elle vous éloigne de votre famille proche et de vos amis,elle vous isole dans un appartement inaccessible vous mette dans une bulle ou seuls les membres de sa famille ont accès.A partir de la elle vous considère comme son patrimoine.Des que votre situation financière change négativement ou que vous preniez une seconde épouse, les problèmes comme.Elle vient dans le mariage les mains videz et ressort après le divorce avec la moitié de vos bien.Machiavéle a raison le mariage est une vraie escroquerie.
