L’APDH appelle les députés sénégalais à réexaminer la loi sur le viol et la pédophilie
The Association for the Protection of Human Rights (APDH) has sent a letter to the President of the National Assembly, El Hadji Malick Ndiaye, and to the members of the 15th legislature, requesting a review of Law No. 2020-05 of January 10, 2020, amending the 1965 Penal Code on the criminalization of acts of rape and pedophilia.
According to the APDH, this law poses serious problems in Senegalese society, due to certain legal cases that have highlighted accusations of rape based on hatred or settling scores. The association cites in particular the case of Fallou Fall, initially sentenced to 15 years in prison for rape, then acquitted on appeal on August 27, 2025 by the Criminal Division of the High Court of Dakar.
The APDH proposes that the review of the law include new measures to:
Strengthen the rights of defense of those unjustly accused.
Allow the prosecution to classify certain unfounded accusations as public order offenses, which can be raised ex officio before the court.
Create a legal barrier to false accusations, to prevent abuses related to defamation or score-settling in rape and pedophilia cases.
In its letter, the APDH emphasizes that this initiative aims to ensure a balance between the protection of victims and the rights of the accused, while consolidating citizens' confidence in the judicial system.
