Litige foncier : la grande désillusion d’un ancien député
On November 3rd, EGBOS (Entreprise générale de bâtiment Omar Sy) filed a motion with the summary proceedings judge of the Dakar court seeking to overturn the ruling of the Dakar High Court granting the heirs of the late Thiaba Diène land which it claims to own and on which it has begun construction. The plaintiff company belongs to former Member of Parliament Omar Sy, who, in his petition, relying on various administrative documents, claims ownership of a portion of land title number 5438/NGA as well as an unregistered plot of approximately 10 hectares located in Ouest-Foire.
Taking the opposite stance, the heirs of the late Thiaba Diène accuse the former parliamentarian of fraudulently appropriating their land. Omar Sy's claim was dismissed, according to Les Échos, which covered the case in its Thursday edition. The newspaper elaborates: "The judge in chambers, ruling last Monday, found the constructions erected on the right-of-way in front of villa number 7466 in Sicap Mermoz to be illegal. Furthermore, he ordered the cessation of work on the right-of-way and the demolition of the structure built thereon, at the expense of SCI Lans Mouhamadou Lamine Fall, under penalty of 100,000 CFA francs per day of delay, starting from the date of service of the decision. The judge also rejected the objection of inadmissibility and the request for a stay of proceedings that he had filed."
