ME BABACAR CISSE : "Farba doit rentrer chez lui, parce que l'hôpital est le prolongement du milieu carcéral"
A member of Farba Ngom's lawyers, Mr. Babacar Cissé, returned to the issue of his client's medical records at a press conference. He asserted that Farba is ill and that on the day of his indictment, he presented medical records to the judge, who ignored them.
Mr. Cissé emphasized that it was subsequently that his lawyers filed a request for a medical expert opinion and that the judge appointed Professor Alassane Mbaye. This expert submitted a medical report to the judge, stating that Farba's state of health was incompatible with life in a prison environment.
However, the public prosecutor opposed the decision and requested a counter-expertise and the appointment of three experts from the Principal Hospital. "The prosecutor does not trust civilian doctors. When he requested the appointment of military doctors, the Medical Association claimed it was incompetent, because military doctors do not fall under the jurisdiction of the association. The judge received this correspondence, which he forwarded to the prosecutor. The latter ended up changing his indictment, requesting the appointment of three civilian doctors. Thus, the Medical Association proposed three professors who conducted an expert assessment and then filed a report confirming Professor Alassane Mbaye's report. The counter-expertise also detected another illness. They stated that Farba Ngom was at risk of sudden death in prison," explained Mr. Cissé.
Under these conditions, the lawyer argues that Farba Ngom should have been released because the law states that when a person's health is incompatible with life in a prison environment, the arrest warrant must be lifted. "We are even told that doctors have requested Farba's transfer to a hospital. But we must understand that the hospital is also a prison, because there will always be prison guards around him. The hospital is an extension of the prison environment. What must be done is to lift the arrest warrant," added Mr. Cissé.
For him, Farba Ngom must leave prison and return home, please the judge to place him under judicial supervision. Mr. Babacar Cissé also pointed out the erroneous interpretation, according to him, of paragraph 2 of Article 140 of the Code of Criminal Procedure.

Maintenant, q'attend les trinonaux pour faire le proces de Faba Ngome et tous ces gens en prison? Oui Farba a beaucoup de dossiers mais ps besoin de les juger tous en meme temps. Il faut juste amener le plus simple pour etre condamner et lui donner une peine qui la clouer en prison en attendant les autres. Le cas Ismaila Madior est un flagrant delit: On a essaye de le corrompre dans son bureau. Il a pris l'argent avant de le retourner quelque jours apres. Tous ceux qui etaient present son inculpe donc pourquoi ne pas le juger et en finir?
