Hired to guard a house under construction, security guard S. Diallo allegedly turned it into a drug den. He was arrested by police in possession of seven packets of marijuana. A search of his room uncovered a bladed weapon. Charged with distributing marijuana and illegal possession of a firearm, he was remanded in custody.

Appearing before the Thiès court for flagrant offenses, he stated that he was in possession of a single packet of Indian hemp intended for his personal use. The prosecutor considered the facts undisputed and requested the application of the law.
