Touba : Il abat un cambrioleur pour défendre son magasin et passe 2 ans en détention préventive
A shopkeeper in Touba paid a heavy price for defending his business from a robbery. C. Sylla was arrested for murder. He had shot and killed the burglar who was breaking into his shop. Convicted by the criminal chamber of the Diourbel High Court, he has just been released after two years of pretrial detention.
On the night of March 3-4, 2023, in Touba, officers from the special police station received a call from the fire department reporting the discovery of a body at the shop of merchant C. Sylla. At the scene, police found the body of a burglar in his twenties lying in a pool of blood. The body had a large wound on the chest, caused by a rifle bullet. When questioned by the police, Cheikh Sylla explained that he had acted to protect his business.
According to his statement, around 3 a.m., criminals broke down the door of his shop. Faced with this intrusion, he used his rifle. After realizing he had hit one of them in the chest and alerting the fire department, the shopkeeper says he fled. The reason? He explains that he doesn't have a permit to carry a firearm and that he inherited the rifle from his late father.
Brought before the criminal court of the Diourbel High Court, C. Sylla maintained his version of events. The public prosecutor requested a 20-year prison sentence.
His lawyer, Serigne Diongue, argued self-defense. "My client did nothing wrong, except courageously defend his property at the risk of his life. This is clearly a case of self-defense," he insisted. The lawyer denounced the prosecutor's disproportionate response, arguing that he refused to acknowledge mitigating circumstances.
At the end of the trial, the criminal chamber dismissed the murder charges as charges of assault and battery resulting in death without intent to kill, as well as the illegal possession of a category 5 weapon.
For the offense, C. Sylla received a two-year prison sentence. After more than two years in pretrial detention, the shopkeeper was released.
