Sanction du Sénégal par la CAF? : Entre rumeurs et réalité juridique, l’éclairage de Me Moustapha Kamara
In response to the controversies surrounding the final and the FIFA president's statements denouncing "unacceptable" behavior, Moustapha Kamara, a lawyer at the Marseille bar and a specialist in sports law, analyzes the CAF regulations. According to him, no provision currently allows for Senegal's victory to be overturned, although disciplinary sanctions remain legally possible.
"I take this opportunity to congratulate the entire Senegalese sports press, the State of Senegal, the ministry, the federation, the technical staff, the coach and all the players, who gave us the great pleasure of bringing back this second star, this second trophy, with great difficulty. But this does honor to our beautiful country."
There have been many rumors and incidents following the events that occurred during and after the match, with the FIFA president stating that there was unacceptable behavior from some players and the Senegalese coach. In my opinion, there is a very clear regulation stipulating that, during a match, if players leave the field without the referee's permission, there can be sanctions, including forfeiting the game. Articles 64 and 82 of the CAF Code, as well as Article 148, outline disciplinary sanctions, including fines, suspensions, match bans, and stadium bans. It's truly a comprehensive list of sanctions provided for in the regulations.
However, for these sanctions to apply, the referee would have had to personally witness the fouls committed by certain players or the coaching staff. But in this case, the referee didn't witness them, and neither did the Moroccan officials. Therefore, even if disciplinary action is taken, the 1-0 result is already final and cannot be overturned: in other words, the trophy and the second star will remain with Senegal.
Furthermore, sanctions can still be taken, since the authorities will examine the images and videos to determine if there were any faults on the part of Senegalese officials, the technical staff or the players, in order to apply possible disciplinary sanctions, such as suspensions, match bans or fines.
Senegal's defensive arguments in perspective
What strategies and arguments can Senegal now use? They must wait for the official notification of the decisions and disciplinary measures. Once the decisions have been made and communicated to the players, the coach, or certain officials—decisions which will necessarily be justified—the federation and the sanctioned individuals can then use the reasons put forward by the disciplinary committee to develop arguments in their favor and implement a defense strategy. Not only do arguments exist, but they also have the option of appealing to the CAF Appeals Committee, or even the Court of Arbitration for Sport (CAS).
Precedents and case law
It's also important to remember that there are precedents and case law concerning similar incidents that have occurred during finals. This isn't the first time, and it won't be the last, because football is a passion, and excesses can happen. The key point, however, is that the person primarily identified as being responsible for the stoppage—the Senegalese coach—is someone we know, with no prior disciplinary record. We must also consider the intense emotional tension surrounding this final, as well as the injustices denounced forty-eight hours before the match and raised by the Secretary General of the Senegalese Football Federation. I believe the governing bodies will take all of this into account, considering the tension surrounding the final and the absence of any prior disciplinary issues.

Quelle réaction pour notre pays ?
Sur ce point je ne suis pas d’accord avec Me Kamara.
Il faut commencer par federer tout les pays qui ont souffert des dysfonctionnements de cette CAN (Cameroun,Nigeria) et documenter ces dysfonctionnements et les nommer dans un mémorandum,le but de cette initiative amener la CAF et le Maroc a reconnaître que tout n’était pas parfait dans cette CAN et que le noeud du problème a été l’arbitrage maison dont le Maroc a bénéficié.
Le but ultime desserrer l’étau que le Maroc et son Pdt de fédération ont noué autour du sport africain dans un cadre plus global élargir leur sphère d’influence c’est à dire le soft power avec l’aide de Motsepe et de Infantino.
« Vous avez gagné avec sérieux, avec respect, sans jamais perdre le sens de ce que vous représentez », a salué Diomaye Faye, avant d’annoncer les récompenses aux joueurs : « J’ai offert à chaque Lion ici présent 75 millions [de francs CFA, soit près de 115 000 euros] et 1 500 mètres carrés sur la Petite-Côte », région au sud de Dakar célèbre pour ses stations balnéaires.
Le staff et les membres de la Fédération ne sont pas en reste puisqu’ils toucheront 50 millions de francs CFA (environ 76 000 euros) et des terrains de 1 000 mètres carrés, toujours sur la Petite-Côte. Les autres membres de la délégation sénégalaise percevront quant à eux 20 millions de francs CFA (près de 30 500 euros) et 500 mètres carrés de terrain sur le littoral. Enfin, 305 millions de francs CFA de primes (environ 465 000 euros) seront partagés entre l’ensemble des agents du ministère des Sports.
Après leur sacre en 2022, les Lions de la Téranga avaient déjà reçu de la part du président Macky Sall 50 millions de francs CFA et deux terrains, un à Dakar et l’autre à Diamniadio.

Quant à la sortie des joueurs du terrain , sortie demandée par l’entraîneur du Sénégal, nous attendons les “sanctions”, qui n’ajouteront que la honte à la malhonnêteté. J’espère qu’ils n’iront pas à ce niveau. L CAF et ses instances dirigeantes appartiennent à toute l’Afrique. Il faut llanvee une pétition en ligne pour interdire à la CAF de prendre une quelconque sanction contre l’équipe du Sénégal et son entraîneur.
