Burkina Faso : Une nouvelle loi interdit aux chefs coutumiers toute affiliation politique ou syndicale

The Transitional Legislative Assembly (ALT) unanimously adopted, on Wednesday in Ouagadougou, the law establishing the status of customary and traditional chieftaincy.

The law defines customary authority as a community governance power based on customs and traditions, and specifically recognizes kings, emirs, canton chiefs, village chiefs, land chiefs, and religious leaders. It grants them a central role in promoting peace, preventing and managing conflicts, safeguarding cultural values, fostering social cohesion, and mobilizing communities for development.

Key innovations include the creation of a national coordination structure for traditional chieftaincies and the establishment of an official register of customary and traditional chiefs, maintained by the territorial administration. The text also imposes a duty of discretion on traditional chiefs, prohibiting them from any political or union affiliation and from participating in elections without first renouncing their titles.

In order to combat self-proclamations, the law provides for criminal penalties against any person declaring themselves a leader without proper investiture.

For the Minister of State in charge of Territorial Administration, Émile Zerbo, this historic law fully recognizes the ancient and structuring role of customary chieftaincy in national construction and constitutes an important lever for the consolidation of peace and the good administration of the territory.
