Aïssata Tall Sall à l'Hémicycle : « Ce n'est pas Farba Ngom qui est à la barre, c'est l'Assemblée nationale »
During the debates on lifting the parliamentary immunity of MP Farba Ngom, parliamentarian Aïssata Tall Sall delivered a vigorous plea. The former Minister of Justice denounced major procedural irregularities, warning against what she considers a serious infringement on the prerogatives of the National Assembly of Senegal.
Addressing her colleagues, she began by outlining the chronology of events she considers indisputable: the MP was searched, taken into custody at the National Gendarmerie, and then brought before the public prosecutor. According to her, it was only after these coercive measures were carried out that the issue of parliamentary immunity was raised, leading to the temporary suspension of proceedings. For the MP, the flaw lies in the initial procedure: "What is contested, what is contestable, and what is illegal is the procedure that was initiated," she insisted.
A denunciation of violations of fundamental rights
In her statement, Aïssata Tall Sall was particularly outraged by the use of the parliamentarian's mobile phone. She believes the device was accessed without the presence of its owner and his lawyers, which she considers a clear violation of legal safeguards.
“What is illegal is having opened the phone without her presence or that of her lawyers,” she stated. She added that the dissemination of material allegedly extracted from this device would constitute a serious violation of the right to confidentiality of communications, a principle protected by the Constitution and the laws governing electronic communications.
Beyond the individual case, the parliamentarian gave the debate an institutional dimension. For her, the issue goes beyond Farba Ngom himself and touches the very heart of Senegalese democracy. "This afternoon, it is not a man who is in the dock. It is the National Assembly," she argued, fearing that this affair could set a precedent allowing the protection of members of parliament to be circumvented.
Brandishing the institution's internal regulations as a shield, she called on her colleagues to be vigilant: "If we let this matter go unpunished, then we should tear up the internal regulations. They will no longer have any meaning."
Aïssata Tall Sall concluded her speech with a striking metaphor, urging the deputies to preserve the autonomy of the legislative branch from the executive: "In the galaxy of democracy, the National Assembly is the sun. Refuse the eclipse that is being offered to you."
