Réintégration d'Ousmane Sonko : des députés de l'opposition saisissent le Conseil constitutionnel
Opposition MPs filed a petition with the Constitutional Council on Monday, June 1st , seeking to overturn the National Assembly Bureau's decision of May 24, 2026, reinstating Ousmane Sonko as an MP. They denounce a flagrant violation of the Constitution.
In a statement received, the signatory parliamentarians inform the Senegalese people as well as national and international opinion that they have appealed to the highest court to have this decision declared unconstitutional.
"Appointed Prime Minister and then elected Member of Parliament in 2024, Mr. Sonko found himself, from the moment of his election, in the situation of incompatibility provided for by Article 54 of the Constitution. By choosing to retain his government functions, he had renounced his mandate as a Member of Parliament in accordance with the Constitution and the internal regulations then in force." His reinstatement, followed by his election to the presidency of the National Assembly on May 26, 2026, constitutes a flagrant and manifest violation of the Constitution and the principle of the separation of powers,” signed the document Daouda Dia, Aïssata Ousmane Diallo, Amadou Diallo, Mami Dou Daw, Salimata Diop Dieng, Mbaye Dione, Thérèse Faye, Barane Fofana, Cheikh Omar Hann, Birima Mangara, Abou Mbow, Fabineta Ndiaye, Anta Babacar Ngom, Thierno Alassane Sall, Maguette Sène, Abdoulaye Sylla and Tafsir Thioye.
According to them, only the Constitutional Council, judge of the validity of the parliamentary mandate and regulator of institutions, can prevent an act of such gravity from escaping all control, they argue.
The signatory MPs also revealed that they had been forced to resort to bailiff summonses to obtain the acts and documents necessary for their appeal, namely the act of reinstatement of Mr. Sonko and the minutes of the plenary session of May 26, 2026.
They maintain that "when seized on June 1, 2026 by Maître Abou Sall, bailiff, the secretary general and the first vice-president of the National Assembly both refused to hand over these documents."
“This refusal to provide representatives of the nation with documents that are public by nature, and even through a bailiff, constitutes a serious infringement on the rights of members of parliament and on democratic transparency. We respectfully call upon the Constitutional Council to fully assume its role by putting an end to what they describe as a breach of trust that undermines the proper functioning of the parliamentary institution,” they denounced. They then added: “We reaffirm our determination to defend, through only legal and peaceful means, the Constitution and Senegalese democracy. No majority, however large, is above the fundamental law of the Republic.”
