Tensions autour du retour de Sonko à l’Assemblée : Cheikh Issa Sall appelle à la "sérénité institutionnelle"
The president of the Union for Integration, Work and Equity (UNITE), Cheikh Issa Sall, warns against what he calls "institutional forcing" around the announced return of Prime Minister Ousmane Sonko to the National Assembly.
In a statement received by Seneweb, he calls for strict respect for fundamental texts and for calming the political climate.
"The Republic of Senegal is going through a pivotal period where the strength of our institutions is being tested by divergent legal interpretations and tensions between the Executive and Legislative branches. Faced with what appears to be a desire to force institutional change, the Union for Integration, Work and Equity (UNITE) party, faithful to its patriotic course of action, wishes to express its deep concern," the statement reads.
According to the leader of UNITE, the current situation raises "major legal questions" regarding the compatibility between government functions and a parliamentary mandate. Citing Article 54 of the Constitution, he reiterates that membership in the government is incompatible with that of a member of parliament.
"Under Article 54 of the Constitution, membership in the government is incompatible with a parliamentary mandate. Mr. Sonko, having chosen to exercise his functions as Prime Minister in December 2024 rather than being installed as a member of parliament, has in fact renounced the immediate exercise of his legislative mandate," explains Cheikh Issa Sall.
Sheikh Issa Sall also believes that the reforms adopted in 2025 cannot be invoked to "regularize retroactively" a situation that arose in 2024.
"Claiming to apply today reforms adopted in 2025 to justify a situation that arose in 2024 constitutes a serious breach of legal certainty. The law cannot be manipulated to regularize personal ambitions retroactively. A mandate cannot be 'suspended' or 'reinstated' if it has never been effectively exercised by an official installation," he argues.
In his argument, the president of UNITE also invokes the philosopher Montesquieu, quoting his famous formula on the separation of powers: "In order that power cannot be abused, it is necessary that, by the arrangement of things, power should check power."
The politician also denounces "the instrumentalization of parliamentary procedures" and "hasty summonses" which, according to him, would weaken the rule of law and could lead to institutional blockages.
Faced with this situation, Cheikh Issa Sall calls on political actors "to put an end to confrontational logic", to "place the higher interest of the nation above crypto-personal calculations" and to preserve "the independence and dignity of institutions".
"Senegal will not be built on circumventing the rules, but on moral rigor and scrupulous respect for the popular will embodied by the Law," he declared.
