Nouvel OFNAC : Ce qui va changer

On July 30, 2025, the Council of Ministers adopted Bill No. 12/2025 establishing the National Anti-Corruption Office (OFNAC), marking a major overhaul of the institution previously dedicated to the fight against fraud and corruption. Presented by Presidential Decree No. 2025-1312 of July 31, 2025, this text, structured in seven chapters, aims to strengthen transparency and good governance, in accordance with Senegal's international commitments, notably the United Nations Convention against Corruption (2003) and the African Union Convention (2003).
The new OFNAC, attached to the Presidency of the Republic and endowed with financial and managerial autonomy, focuses exclusively on the prevention and repression of corruption, illicit enrichment, and related offenses. Auditing and anti-fraud missions, now assigned to the Court of Auditors and the General State Inspectorate, are excluded from its responsibilities. However, OFNAC can request experts for its investigations, access information without opposition from banking or professional secrecy, and cooperate with national and international organizations.
The text introduces several key reforms:
Composition and appointment : OFNAC has 12 members, including a president and a vice-president, appointed by decree following a call for applications. Their term, which is non-renewable, lasts five years, with a mandatory oath before the Dakar Court of Appeal.
- Enhanced independence : Members, protected from prosecution for their opinions or decisions, operate without receiving outside instructions. Strict restrictions prevent conflicts of interest.
- Transparency : OFNAC's annual activity reports will be public, and the institution will be able to receive asset declarations, in accordance with the law on this subject.
- Investigative powers : OFNAC can initiate proceedings on its own initiative, be referred to by citizens, authorities or whistleblowers, and has the powers to freeze assets or seize funds linked to offences.
The bill responds to criticisms, such as those of MP Amadou Ba, who denounced posthumous impunity in embezzlement cases. Although the text does not explicitly mention posthumous recovery, it strengthens mechanisms for seizing assets derived from corruption and provides for a seven-year statute of limitations for offenses, suspended if the perpetrator is on the run.

C’est un vrai problème. Il faut l’accepter et éviter les approches sectaires et partisanes

Quant à l'OFNAC qu'il dit être pour eux, elle enquête sur son frère, et il limoge la présidente avant sa fin de mandat, et les enquêteurs. Limogeage illégal, mais l'inhumain dictateur s'en fiche. Et pour quitter le pouvoir, il manipule les textes pour qu'ils soient les seuls que l'OFNAC ne poursuivra pas. Une OFNAC qui était pourtant pour eux.
Quand je vous répète qu'il est inhumain... il n'y a pas de possibilité de ne pas le voir. Mais des médias réussissent toujours à le maquiller en humain.
